Terms of Use

1. Acceptance of Terms

By accessing or using Caracal's API and related services (the "Service"), you agree to these Terms of Use. This includes any use of the API directly, not just through the dashboard — calling the API at all means you accept these Terms.

If you do not agree, do not use the Service.

2. Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of API keys
  • All activity conducted under your account
  • Revoking compromised credentials immediately

3. Lawful Use and Biometric Consent

You represent and warrant that:

  • You have all necessary rights and permissions to submit images and biometric data to the Service
  • You have obtained explicit, informed consent from each end user prior to collecting or submitting their biometric data to Caracal, and any legally required notices have been given
  • Your use complies with applicable biometric privacy and data protection laws

You are solely responsible for compliance with laws governing biometric data in your jurisdiction, including obtaining and maintaining records of consent. We recommend logging, for each end user: the timestamp consent was given, the IP address it was given from, and which version of your consent language was presented. Caracal does not collect this consent on your behalf.

4. Prohibited Uses

You may not use the Service for:

  • Mass or unlawful surveillance
  • Law enforcement use without proper legal authority
  • Real-time public tracking of individuals without their knowledge
  • Discriminatory profiling
  • Any other unlawful activity

We may suspend or terminate accounts for prohibited use, at our discretion.

5. Acceptable Use

Separately from the prohibited uses above, you agree not to:

  • Submit images without proper authorization
  • Use the Service to build a competing biometric API
  • Attempt to reverse engineer the models
  • Circumvent rate limits or entitlement controls

We may suspend or terminate accounts that violate these Terms.

6. Data Ownership and Our Role

You retain ownership of all data you submit to the Service. Caracal acts as a data processor, providing the infrastructure to register, search, and verify faces on your behalf — we do not determine the purpose or legal basis for processing your end users' data, and that responsibility remains yours (see Section 3).

Caracal does not sell biometric data, in any form, to any third party.

7. Data Retention and Deletion

Data is retained and deleted in accordance with our Data Retention Policy. In summary: you set a retention period per gallery (30 days by default), you may delete registrations or entire galleries at any time via the dashboard or API, and such deletion is immediate and irreversible once processed.

8. Security

We implement reasonable administrative, technical, and organizational safeguards, including:

  • Encryption in transit (TLS)
  • Encryption at rest
  • Access controls limiting who can reach production systems
  • Audit logging of API transactions

No system can be guaranteed 100% secure.

9. Plans and Billing

Paid plans are billed through Stripe according to the pricing displayed at checkout.

You may cancel at any time through the billing portal.

Access continues until the end of the current billing period.

10. Service Availability

The Service is provided on an "as‑is" and "as‑available" basis.

We do not guarantee:

  • Uninterrupted availability
  • Error‑free operation
  • A specific accuracy rate for any given input

11. Limitation of Liability

To the maximum extent permitted by law:

Caracal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Service.

Caracal's total liability for any claim arising from the Service shall not exceed the total amount paid by you to Caracal in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold Caracal harmless from any claims, damages, or liabilities arising from:

  • Your use of the Service
  • Your failure to obtain required consent
  • Your violation of applicable laws

13. Governing Law

These Terms are governed by the laws of [Insert Your State/Country], without regard to conflict of law principles.

14. Changes

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
